Terms of Service

1. Acceptance and operator

TattooCoverUpGenerator ("we," "us," or "our") is an independent developer team operating TattooCoverUpGenerator.com (the "Service") in the United States. By creating an account, purchasing credits, or otherwise using the Service, you confirm that you are at least 18 years old, have read and accepted these Terms and our Privacy Policy, and have authority to accept them for yourself or your organization. If you do not agree, do not use the Service.

2. Service and AI limitations

The Service provides AI-assisted visual concepts for discussing a possible tattoo cover-up. It is a digital, intangible software service made available after payment confirmation. It does not remove tattoos, provide medical advice, guarantee a result, or replace the assessment, redraw, or work of a qualified tattoo artist.

The Service relies on third-party AI and infrastructure providers. Availability and output quality may be affected by those providers. AI-generated content can be inaccurate, incomplete, or unsuitable for tattooing. Always have a qualified, experienced cover-up tattoo artist review any concept before making a permanent change to your body.

3. Accounts and security

You must provide accurate, complete account information and keep your login credentials and billing email secure. You are responsible for activity under your account and must promptly tell us about suspected unauthorized access. Do not share your credentials or use the Service on behalf of an organization unless you are authorized to bind that organization.

4. Credits and one-time purchases

The Service uses credits for generation runs. Each displayed credit pack is a one-time purchase; we do not offer subscriptions or automatic credit recharges. Completing a purchase authorizes TattooCoverUpGenerator to charge the amount shown at checkout to your selected payment method.

Purchased credits do not expire while your account remains active. Promotional or free credits may have separate terms or expiry dates shown when they are granted. Credit packs, prices, credit costs, and any applicable taxes are shown at checkout. We may change future offerings and prices, but not the credits already purchased under these Terms.

5. Payments and refunds

Payment card data is processed by Waffo Pancake, our PCI-DSS-compliant payment processor; we do not store full payment-card details on our servers.

Purchased credits that have not been used may be refunded in full if you contact us within 7 days after purchase. Used credits are not refundable. Duplicate charges caused by a billing error are refundable in full. Any mandatory refund, withdrawal, or consumer-protection rights under applicable law remain unaffected.

To request a refund or report a billing error, email support@tattoocoverupgenerator.com with your account email address, transaction ID, and reason. Please contact us before filing a payment dispute; we aim to acknowledge requests within 2 business days and resolve confirmed billing errors within 5 business days.

6. Account closure

You may request account deletion by emailing support@tattoocoverupgenerator.com. After a deletion request, we retain your account and any unused purchased credits for 90 days so that you may ask us to restore access. After that period, the account and unused credits are deleted or expire and are not refundable, except where required by applicable law. Our retention and deletion practices are described in the Privacy Policy.

7. Your content and AI output

You retain your rights in the photos, prompts, and other content you submit ("Input"). You grant us a limited, non-exclusive license to host, process, transmit to service providers, and use Input solely to provide, secure, and support the Service. We do not use your Input to train AI models without your explicit consent.

As between you and us, you may use the output generated from your Input for lawful purposes. You are responsible for ensuring that you have the rights to submit Input and for reviewing output before relying on it. Outputs may be affected by third-party AI providers, and we do not guarantee that any output is unique, accurate, available, or fit for a particular purpose.

8. Acceptable use

You may use the Service only for lawful purposes. You must not use it to generate or distribute illegal, defamatory, harassing, fraudulent, sexually exploitative, or harmful content; sexualized content involving minors; malware, phishing material, or cyberattack tools; deceptive deepfakes; or content that infringes another person's intellectual-property, privacy, or publicity rights. The detailed prohibited-content rules, reporting process, and enforcement process are in our Acceptable Use Policy.

You must not bypass security or usage limits, interfere with the Service, resell or share access without our written approval, systematically scrape or collect outputs, or use the Service's inputs, outputs, or model responses to train, fine-tune, benchmark, distill, or develop a competing AI or machine-learning model. Do not present AI output as professional medical, legal, financial, or tattooing advice.

9. Privacy and data security

Your use of the Service is also governed by our Privacy Policy. We use reasonable safeguards to protect data, but no internet service is completely secure. Please do not upload content you do not want processed for cover-up planning.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, non-infringement, or AI-output accuracy. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our total liability for claims relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.

11. Suspension, termination, and changes

We may suspend or terminate access when reasonably necessary to protect the Service, users, rights holders, or legal compliance, including for material violations of these Terms or suspected fraud. We may update these Terms from time to time. For material changes, we will provide at least 14 days' notice by email or through the Service before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.

12. Governing law and contact

These Terms are governed by applicable laws of the United States, without regard to conflict-of-law rules. Before starting formal proceedings, please contact us at support@tattoocoverupgenerator.com so that we can try to resolve the matter informally.
